CITY DOCUMENTS/RECORDS

The California Public Records Act was created to guarantee “that access to information concerning the conduct of the people’s business is a fundamental and necessary right of every person in the state.” Public records are open to inspection at all times during the city’s office hours and every person has a right to inspect and request a copy of any identifiable public record, except as provided for by law. Within 10 days of receipt of your request, one of the following will take place: copies will be provided, you will be notified when the records will be available for review, if there are voluminous records, you will be notified if additional time is necessary to compile the records, or you will be notified if the request cannot be granted and the reason why.

What is an ordinance?

Ordinances are the laws of the City. The City Council adopts ordinances which amend, repeal or supplement the city’s municipal code. These ordinances may be passed by the City Council as long as they are not in conflict with federal or state laws. An ordinance is the most binding form of action taken by the Council. Approval of an ordinance requires a first and second reading, with a few special exceptions; ordinances take effect 30 days after they are adopted (at the second reading).

The Indian Wells Municipal Code codifies ordinances (laws) that have been adopted by the City Council for easy access by the public and it is updated semi-annually.

What is a resolution?

A resolution constitutes a written action or decision/opinion or intention of the City Council. A resolution is adopted in one meeting.

What are Minutes?

The minutes of the City Council meeting are the official record of the action taken by the City Council at a City Council meeting. The minutes are posted on the website after they have been approved by the City Council usually at the following meeting.

Economic Disclosures

The City Clerk is the filing official for all state and local financial disclosure statements, which include Statements of Economic Interest for members of the City Council, designated employees and certain advisory body members. The purpose is to disclose assets and income which may be materially affected by their actions. Disclosure statements are available from the City Clerk's Department.
